ELIGIBILITY The Drawing (the “Drawing”) is open to legal residents of the State of Florida, are at least twenty-one (21) years old at the time of entry, and who are not legally disqualified from possessing a firearm. Employees of The Veterans Council of Indian River County and other companies associated with the promotion of the Drawing and their respective immediate families (spouse, parents, siblings, and children) and household members are not eligible. SPONSOR The Drawing is sponsored by The Veterans Council of Indian River County (the “Sponsor”), located at 2525 St. Lucie Blvd, Vero Beach, FL 32960, United States of America. The winner must meet the requirements under all local, state, and federal firearms laws and regulations, as applicable, and must make their own arrangements with Sponsor for delivery and transfer of the firearm(s) and other included item(s), including, obtaining all firearms licenses and permits that may be required. The winner must confirm any local magazine or firearm restrictions. The winner must complete an ATF Form #4473 and pass a NICS background check at Paul’s Guns, a Federal Firearms Licensed Dealer located at 9090 N Highway US 1, Sebastian, FL 32958. The VCIRC will not be responsible for any fees collected by the retailer to perform these services. Such fees shall be at the winner’s sole expense. Failure to comply with each of these requirements will results in forfeiture of the prize. By entering this Drawing, participants agree to these Official Rules and to the decisions of the Sponsor, which are final and binding in all respects. Entrants shall not be eligible to win more than one prize in any calendar year. THIS OFFER AND ENTRIES ARE VOID WHERE PROHIBITED OR RESTRICTED BY LAW. OFFER IS SUBJECT TO ALL APPLICABLE FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS. AGREEMENT TO OFFICIAL DRAWING RULES Participation in the Drawing constitutes the entrant’s full and unconditional agreement to and acceptance of these Official Drawing Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Drawing Rules and fulfilling all other requirements set forth herein. DRAWING PERIOD The Drawing begins on Saturday, October 03, 2020 at 7:00 AM ET and ends on Saturday, November 07, 2020 at Noon ET (the “Drawing Period”). Entries that are submitted before or after the Drawing Period will be disqualified. HOW TO ENTER Visit the Veterans Council of Indian River County website at www.helpircvets.org to make the suggested donation and automatically be entered into the drawing. Visit the Veterans Council of Indian River County (2525 St. Lucie Blvd, Vero Beach, FL 32960) during the Drawing Period to make the suggested donation and automatically be entered into the drawing. All eligible participants will be entered into the prize drawing. Visit the Clay Shoot event at the Indian River County Shooting Range located 10455 102nd Terrace, Sebastian, FL 32958 on Saturday, November 07, 2020 between 8am and noon to make the suggested donation and automatically be entered into the drawing. ALTERNATIVE METHOD OF ENTRY You may also enter the Drawing by mailing a 3×5 index card with your name, mailing address, phone number, email address and date of birth to the following address during the Drawing Period: The Veterans Council of Indian River County ATTN: Jim Romanek PO Box 1354, Vero Beach, FL 32961, United States of America *Alternative entries must be received by the person(s) identified above prior to the end of the Drawing Period. All entries become the property of the Sponsor and will not be acknowledged or returned. PRIZE DRAWING On or about Saturday, November 07, 2020, one or more entities working on behalf of the Sponsor will select the potential winner(s) at random from among all eligible entries received. The odds of being selected depend on the number of entries received. The Sponsor will attempt to notify the potential winner(s) via email, or telephone on or about Monday, November 09,2020. If the potential winner(s) cannot be contacted within five (5) days after the date of the first attempt to contact him/her/them, the Sponsor may select an alternate potential winner from among the remaining eligible entries. Any prize having a total announced value of $5,000.00 or more must be offered in strict compliance with §849.094, Florida Statutes. The winner(s) of the Drawing will receive one of the following: FN AR Memorial Rifle ($1,749) FN 503 9mm Pistol ($549) Prize retail value may differ at the time of award. The specifics of the prize(s) will be solely determined by The Veterans Council of Indian River County. No cash or other prize substitution(s) will be permitted, except at The Veterans Council of Indian River County’s discretion. All prizes are non-transferable and subject to income tax. Any and all prize-related expenses, including without limitation, any and all federal, state, and/or local income taxes, shall be the sole responsibility of the winner. Any winner of a prize valued in excess of $600.00 at the time of award must provide his or her social security number, EIN, or TIN to The Veterans Council of Indian River County and shall receive an IRS Form 1099. Acceptance of a prize constitutes permission for The Veterans Council of Indian River County to use a winner’s name, likeness and entry for purposes of advertising and promotion without further compensation, unless prohibited by law. All prizes must be claimed at The Veterans Council of Indian River County, 2525 St. Lucie Avenue, Vero Beach, FL 32960, United States of America during normal operating hours and within ten (10) days from the time of award notification. WINNER NOTIFICATION The potential winner(s) will be notified by email, or phone. If a potential winner cannot be contacted, is ineligible, or fails to claim the prize within ten (10) days from the time award notification was sent, the potential winner forfeits the prize. Potential winners must continue to comply with all terms and conditions of these Official Drawing Rules, and winning is contingent upon fulfilling all requirements including appearing in person, undergoing age and identity verification, background checks, permitting as described by federal gun laws, and the payment of any fees associated with such legal verification as described. All drawing requirements will be verified by both the Veterans Council of Indian River County and Paul’s Guns located at 9090 North US Highway 1, Sebastian, FL 32958. In the event that a potential winner is disqualified for any reason, the Sponsor will award the applicable prize to an alternate winner from among the remaining eligible entries. Only three (3) alternate selections will be held, after which time a prize will not be awarded. TERMS & CONDITIONS In the event that the operation, security, or administration of the Drawing is impaired in any way for any reason including, but not limited to fraud, virus, bug, worm, unauthorized human intervention, or other technical problem; or in the event the Drawing is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Drawing to address the impairment and then resume the Drawing in a manner that best conforms to the spirit of these Official Drawing Rules, or (b) terminate the Drawing and, in the event of termination, award the prize from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Drawing, or to be acting in violation of these Official Drawing Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Drawing may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Drawing Rules shall not constitute a waiver of that provision. RELEASE & LIMITATIONS OF LIABILITY By participating in the Drawing, entrants agree to release and hold harmless The Veterans Council of Indian River County, Florida, its affiliated or related entities, and their respective individual trustees, officers, employees, agents, volunteers, contractors, successors and assigns, as well as any other entities associated with the Drawing and each of their respective officers, directors, employees, shareholders, representatives, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Drawing or receipt or use of the prize (including any travel or activity related thereto) including, but not limited to: (a) any technical errors associated with the Drawing, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Drawing; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Drawing, including, without limitation, errors that may occur in the administration of the Drawing, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Drawing-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Drawing or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Drawing. The entrant waives the right to claim any and all damages, including, but not limited to, punitive, consequential, direct, or indirect damages. Nothing herein shall serve as a waiver of sovereign immunity by any of the Released Parties to whom sovereign immunity may be available (§768.28, Florida Statutes), nor shall anything herein be construed as consent by any of the Released Parties to be sued by any entrant or any other third party. DISPUTES Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Drawing or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Indian River County, Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Drawing Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Drawing, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Florida.
